BIG WIN: Judge strikes down Dems lawsuit against Trump’s national emergency

Washington, D.C., district court Judge Trevor McFadden chucked Democrats’ lawsuit seeking an injunction against President Trump’s emergency border wall funding reallocation, saying that the matter is a political dispute and politicians lack standing to make a legal case.

“To be clear, the Court does not imply that Congress may never sue the Executive to protect its powers,” McFadden wrote.

But he said that because the House failed to show it has standing in court, the lack of binding precedent showing they can sue and rulings made in related cases, “the Court cannot assume jurisdiction to proceed to the merits.”

It is a much needed win for the President who declared a National Emergency months ago to fund the wall.
